§1 Scope


The Terms and Conditions apply to all legal transactions between Campus Deutsch, in particular to the services provided within the framework of the courses offered by Campus Deutsch on its website, and its clients. The version valid at the time of conclusion of the contract shall be decisive. The customer's own terms and conditions are expressly rejected. If other terms and conditions are agreed, they shall only be valid if confirmed in writing by an authorised person, even if no express reference is made to this in the case of amendments. These possible amendments shall only apply to the individual business case. The original German version shall apply; other versions are for information purposes only. 

The GTC are accepted in full by the customers. "Customers" may be both consumers within the meaning of the Consumer Protection Act and companies. 


§2 Conditions of participation


Courses or individual trainings with younger persons can also take place, but a written request and confirmation by an authorised person of Campus Deutsch is required.


§3 Description of the service


Campus Deutsch offers language courses in the form of (online) language tuition in groups, small and very small groups and in the context of individual tuition. Content from all four skill areas is trained. Special content such as Austrian regional studies, phonetics and literature are also taught as required. 


§4 Registration modalities and payment


Registration for Campus Deutsch courses takes place online and is binding. Partial payments are not possible.

After submitting the online form, the course fee must be paid immediately by bank transfer. The order of the courses will be determined by the date of receipt of payment. After submitting the online form, you will be sent a payment request with further information by e-mail. The bank transfer should be made to the following account, indicating the name of the participant and the course level under the purpose of payment:

Please note: Any bank charges are to be paid by the participant.


Registrations must be received at least 1 week before the course starts. After receipt of the registration and payment, Campus Deutsch will send the client a confirmation of registration containing all important information as well as the invoice.

In the case of a later entry into one of the courses or an early exit, no aliquot payment of the course fee is foreseen.

Registrations only become valid upon full payment of the fee. No booking fees will be charged. The respective registration deadline must be observed by the clients.


§5 Prices


The course fees include the costs for 

the running of the course, 

course materials, such as (online) textbooks, 

the use of the learning platform "Deutschfuchs" and 

the use of the video conferencing service "Zoom". 


No price reductions can be granted on course material already provided (e.g. from a previous course), e.g. if you already have the textbook at home. The prices quoted are gross prices: Course prices do not include VAT. Payments for course fees must be made 1 week before the start of the course without exception. Campus Deutsch asks its clients to make payments in Euro (EUR) only.

The issuing of certificates/confirmations of attendance from an ongoing course is free of charge. 


§6 Payment


Total payments must currently be made by bank transfer.

§8 Cancellations


Should a participant have to cancel a course, a written cancellation of a booked course must be made at least one week before the course starts. The cancellation is not valid until written confirmation has been received from Campus Deutsch. After that - even if the course or individual training is not attended - the full course fee is due. 

The following cancellation fees will be charged: 

Up to seven days before the start of the course: the cancellation fee corresponds to 25% of the course fee; this cancellation fee will not be refunded by Campus Deutsch.

Thereafter or in case of no-show of the client or course cancellation: No fees will be refunded, the full course fee has to be paid.


Additional information: For bookings made at a distance, i.e. in particular internet bookings, participants as consumers have a legal right of withdrawal within a period of fourteen calendar days, calculated from the day of the conclusion of the contract, according to the Distance and Foreign Business Act.


§9 Cancellation by Campus Deutsch


If the lessons are disturbed by the behaviour of a participant or if he/she behaves disrespectfully towards other participants or the teacher, disregards the conditions of participation or acts contrary to the instructions of the teaching staff, Campus Deutsch has the right to withdraw from the contract without notice after a fruitless warning. In this case the customer has no right to a refund of the course fees.


§10 Data protection (photos and videos)


In the course of the registration process we collect and process your data. Data such as family name and first name, possibly academic degree, address as well as e-mail address, telephone number, also information about the type and content of the contractual relationship as well as other personal data provided by the customer or possibly third parties when initiating the contract or during the contractual relationship are processed. The customer consents to this processing and use of the data. In addition, the customer agrees to the use and transfer of specific data (e.g. name and country of origin) to teachers of Campus Deutsch for use in lessons. The client also agrees that recordings of the lessons can be made for quality measures or for the better understanding of the course participants. The photos of the participants shown in the gallery on the Campus Deutsch website have been made available to Campus Deutsch voluntarily and the client agrees to their publication on the Campus Deutsch website.

The customer has the right at any time to receive information free of charge about the origin, recipient and purpose of his/her stored personal data. In addition, the participant has the right to demand the correction or deletion of this data. If consent to data processing has been given, this consent can be revoked at any time for the future. In addition, the customer has the right to demand the restriction of the processing of personal data under certain circumstances.

§ 11 Hosting


Our website is hosted by IONOS SE. The provider is IONOS SE, Elgendorfer Str. 57, 56410 Montabaur.

§12 Applicable Law


The contractual relationship between Campus Deutsch and the customer shall be governed by Austrian law, excluding the conflict of laws rules and the UN Convention on Contracts for the International Sale of Goods. If the contractual relationship is a consumer transaction within the meaning of the Consumer Protection Act (KSchG), the general place of jurisdiction, i.e. the place of residence or registered office of the defendant, shall apply to legal actions.


§13 General information about the courses 


Teaching unit

The duration of the courses is given in teaching units (UE). 1UE = 45 minutes.


Number of participants

The maximum number of participants in the online courses is 15.


Changes in the course programme

Changes in the programme are possible due to organisational reasons. The realisation of a course depends on a minimum number of participants. Should the number of participants fall below this minimum, Campus Deutsch reserves the right to hold courses in a shortened form. Campus Deutsch also reserves the right to change course days, starting times, dates, teachers and possible cancellations. Compensation for any expenses incurred and other claims against Campus Deutsch cannot be derived from this. The same applies to changes of dates or timetables that become necessary at short notice. If a course has to be cancelled, any amounts already paid will be refunded. The information on this website has been written in good faith, but Campus Deutsch accepts no responsibility for any typographical errors.


Confirmations of participation and certificates

In order to receive a confirmation of participation or a certificate, you must have at least 75% attendance during the entire course. The positive certificate provides information about the level of the course according to the "Common European Framework of Reference for Languages".


Teaching modalities

Our courses are conducted as online courses. Campus Deutsch reserves the right to switch from online to face-to-face teaching if necessary. The procurement of the necessary technical equipment is the responsibility of the client. Campus Deutsch provides a suitable video conferencing application as well as a learning platform for the duration of the language course.


Falsification of documents

Any attempt to falsify documents (certificates, confirmation of participation) will be reported to the police and will in any case result in exclusion from the course. In the case of attempted fraud during the final examinations, the right to a certificate is forfeited. The participant may also be excluded from the course.


Liability

No liability is accepted for the learning materials provided (digital course materials, Deutschfuchs platform) and own equipment such as PCs, laptops, cameras, etc. Campus Deutsch provides the infrastructure for the course. Campus Deutsch provides the infrastructure for the teaching and learning activities, the responsibility for the learning success lies with the participants themselves. No guarantee is given for the individual learning success.

§15 Terms of Use regarding the “Deutschfuchs” learning platform


Description of the services

The Deutschfuchs access is a digital subscription which Campus Deutsch has purchased for the purpose of teaching and which is made available to Campus Deutsch customers free of charge. It provides access to various Deutschfuchs materials during the course time with the possibility to use and download documents and tables from the material database or to use applications and games. The content is regularly supplemented and also expanded with current and occasion-related materials. 


These services are free of charge for Campus Deutsch participants.


Clientele

The Deutschfuchs offer is aimed exclusively at freelance or commercially active language teachers, companies, educational institutions (schools) and their sponsors as well as (state) organisations.


Cancellation

The offer is not directed at consumers. By placing an order, you confirm that you are acting as an entrepreneur and that you waive your right of withdrawal. For the participants of Campus Deutsch this means that the platform is freely accessible.


Use

The Deutschfuchs access can be used on any number of devices (also simultaneously).

Each access (combination of user name and password) may be used by a maximum of one person whose name is linked to the access. 


Sharing of content

(1)

A student account entitles one person to access the Deutschfuchs service. The owner of the account (= the teacher) determines individually for which content the student has access rights. A student account may not be used by anyone other than the student. Pupil accounts can be deleted and newly created on a daily basis.

Student accounts may only be created for persons who have a direct teaching relationship with the teacher. This is characterised by the fact that the teacher uses his or her personal expertise or training to convey the teaching content and is in personal contact with the student (also electronically or by telephone). This is regularly only guaranteed if the teacher completes 10 or more teaching hours per year with this student. The establishment of pupil access exclusively against payment and without teaching activity is not permitted.

The student may use the materials assigned to him/her exclusively for his/her own private continuing education purposes. Business or commercial use as well as further distribution, duplication and public performance are not permitted.

Instead of the pupil accesses mentioned in paragraph (1), through which access to the material can be granted electronically, the written contents (PDF files) of the Deutschfuchs database may also be reproduced for the maximum number of pupils (S) by classical means (printout, copy or dispatch). A combination of classic duplication and release via pupil access is also possible, provided the maximum quantity (S) is not exceeded.

Pupils with whom there is no longer a teaching relationship must be deleted promptly. These accesses can then be used immediately for new pupils.

Any other distribution, combination, merging or sale of the content is not permitted.

(7)

Uploading or making available the Deutschfuchs content in file form, including excerpts, without effective protection mechanisms against unauthorised access (e.g. in forums, public storage, social media) is not permitted. Embedding in pure self-learning courses is not permitted without separate approval.

Each document created contains visible and invisible watermarks that clearly assign a document to an access (ID-coded) and the time of creation.


Editing of content

The contents and materials of Deutschfuchs may not be edited or rearranged. In particular, the Deutschfuchs logo and the copyright line at the end of a document may not be removed.


Availability of services

The online services of Deutschfuchs have an availability of at least 99% on an annual average. Maintenance work may be carried out and we will inform you of this either by e-mail or by an insertion after login.


Liability

The content and materials of Deutschfuchs are based on the Common European Framework of Reference for Languages and have been prepared to the best of our knowledge and belief. Nevertheless, we cannot accept any liability for the accuracy, completeness and freedom from errors of the content. In particular, knowledge of all the contents of a level does not guarantee success in an examination. All persons, places and situations mentioned are fictitious. Any similarities to real persons are purely coincidental.


§16 Final provisions 


Should individual provisions of the General Terms and Conditions of Business, including these provisions, be wholly or partially invalid or should the Terms and Conditions of Business contain a loophole, the validity of the remaining provisions or parts of such provisions shall remain unaffected. The invalid or missing provisions shall be replaced by the respective statutory provisions. The fact that Campus Deutsch does not exercise some or all of the rights to which it is entitled shall not be construed as a waiver of such rights. Prices may be changed at any time. Courses may be cancelled, postponed or changed due to low enrolment. The terms and conditions can be changed by Campus Deutsch at any time and are effective for existing and concluded contractual relationships.
